By accessing the Simnity website or purchasing our services, you agree to be bound by these Terms and Conditions. Please read them carefully before completing any transaction.
1. Description of Service
Simnity acts as a global aggregator of telecommunications services, providing users with downloadable eSIMs (embedded SIM cards) for mobile data, local/international voice calls, and SMS services in over 190 countries. We partner with Tier-1 network providers to facilitate these connections.
2. Eligibility and Registration
2.1. Account Creation
You must be at least 18 years of age to purchase a Simnity eSIM. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.2. Mandatory KYC (Know Your Customer)
In accordance with international telecommunications regulations and anti-money laundering (AML) laws, certain regional plans (e.g., Turkey, India, Thailand, and parts of the EU) require identity verification.
You agree to provide accurate and verifiable identification (Passport/ID) when requested.
Failure to provide required KYC documentation will result in the immediate suspension or non-activation of the eSIM without a refund.
3. Device Compatibility and Unlocking
3.1. User Responsibility
It is your sole responsibility to ensure that your mobile device is:
eSIM Compatible: Not all smartphones support eSIM technology.
Carrier Unlocked: Your device must not be "locked" to a specific mobile network.
3.2. No Liability
Simnity shall not be held liable, nor will a refund be issued, if you purchase an eSIM for a device that is locked or incompatible. We recommend checking our "Compatibility List" prior to purchase.
4. Payments and Billing
Prepaid Nature: All Simnity services are provided on a prepaid basis.
Taxes: Prices displayed are inclusive of Indirect Taxes unless stated otherwise.
Payment Security: Simnity does not store full credit card information. All transactions are handled via encrypted Tier-1 payment gateways (Stripe/PayPal/Razorpay).
5. Refund and Cancellation Policy
5.1. Digital Goods Nature
Due to the digital nature of eSIMs, once a QR code or activation code is generated and delivered to you, the product is considered "opened."
5.2. Eligibility for Refund
Refunds will only be considered if:
The eSIM cannot be activated due to a confirmed technical failure on Simnity's side.
You have not yet scanned the QR code (for non-activated packages) and request a refund within 14 days of purchase.
5.3. Non-Refundable Scenarios
No refunds will be issued if:
You have already consumed data or used call/SMS credits.
Your device is locked or incompatible (see Section 3).
You provide incorrect information during the KYC process.
6. Fair Usage Policy (FUP)
To ensure high-quality service for all users, Simnity and its network partners reserve the right to throttle data speeds or temporarily suspend accounts that exhibit "excessive" or "abnormal" usage patterns that negatively impact the network. Use of Simnity eSIMs in industrial modems or for automated SMS/spamming is strictly prohibited.
7. Service Availability and Limitation of Liability
Network Quality: Service depends on local carrier infrastructure. Simnity does not guarantee 5G/4G speeds in all areas, as coverage may be affected by geography, weather, or local network congestion.
Liability Cap: To the maximum extent permitted by law, Simnity’s total liability for any claim arising from the service is limited to the total amount paid by the user for the specific eSIM in question.
8. Account Termination and Data Deletion
You may request the termination of your account at any time. As our system does not currently support automated self-deletion, you must Open a Support Ticket via your user dashboard. Our team will verify and purge your identifiable data within 24–48 hours, subject to legal financial retention requirements (see our Privacy Policy).
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes shall be settled through individual arbitration and not as part of a class action.
