"eSIM" - Embedded SIM, a digital SIM card built into your device

"Data Plan" - A prepaid data package purchased through Simnity
"Device" - Your eSIM-compatible smartphone, tablet, or other device
"Network Partner" - Third-party mobile network operators providing connectivity
"QR Code" - Quick Response code used to activate your eSIM profile
"ICCID" - Integrated Circuit Card Identifier, a unique identifier for your eSIM
"Fair Use Policy" - Usage limits and restrictions applicable to data plans
"Content" - Any text, images, data, or other materials you upload or transmit through our services
3. Service Description
3.1 eSIM Services
Simnity provides prepaid eSIM data services enabling you to access mobile data in multiple countries without physical SIM cards. Our services include:

Our eSIM services operate on third-party mobile networks. While we strive to partner with reliable providers, we do not control:

4. Account Registration and Security
4.1 Account Creation
To use our services, you must:

5.2 Pricing and Payment

6. eSIM Activation and Usage
6.1 Device Compatibility

We do not provide refunds for purchases made with incompatible or locked devices.

6.2 eSIM Installation
Upon purchase, you will receive:

Installation Steps:

Ensure device has internet connectivity (Wi-Fi recommended)

Scan the QR code using your device's camera or settings

6.3 eSIM Activation

Validity Period: Begins when you first connect to a Network Partner in your destination

Expiration: Data Plans expire after the specified validity period (e.g., 7 days, 30 days)

Unused Data: Unused data does not roll over after expiration

Reactivation: Expired eSIMs cannot be reactivated; you must purchase a new plan
6.4 Multiple eSIM Profiles
Most devices support multiple eSIM profiles. You may install multiple Simnity eSIMs, but:

Only one eSIM can be active at a time (per device limitation)

Switching between eSIMs is done through device settings

Each eSIM is tied to a specific Data Plan and cannot be shared
6.5 Data Usage and Monitoring

Data Tracking: Monitor your data usage through our mobile app or website

Usage Alerts: We will notify you when you reach 80% of your data allowance

Overage: Once your data allowance is exhausted, service stops (no overage charges)

Top-Up: Purchase additional data through our app or website
7. Fair Use Policy
7.1 Prohibited Uses
You agree NOT to use our services for:
Illegal Activities:

Engaging in any illegal activity or facilitating illegal conduct

Violating any local, national, or international laws

Infringing intellectual property rights
Network Abuse:

Excessive or abusive use beyond reasonable personal consumption

Peer-to-peer (P2P) file sharing or torrenting

Operating servers, bots, or automated systems

Video streaming in excess of fair use limits
Security Threats:

Attempting to gain unauthorized access to systems or networks

Conducting denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks

Spamming, phishing, or sending unsolicited communications
Commercial Use:

Reselling, sublicensing, or redistributing our services

Using services for commercial purposes without written authorization
7.2 Data Speed Management
To ensure network quality for all users:

Network Partners may implement traffic management during peak times

Certain services (e.g., video streaming) may be subject to speed throttling

Unlimited plans are subject to fair use policies (typically 10-50GB high-speed data, then reduced speeds)
7.3 Consequences of Violation
Violation of the Fair Use Policy may result in:

Immediate suspension or termination of services

Account closure without refund
-
Legal action if applicable

Reporting to relevant authorities
8. Refund and Cancellation Policy
8.1 General Refund Policy
Due to the digital nature of our services:

No refunds are provided for eSIMs that have been activated or where the QR code has been scanned

No refunds for unused data after activation

No refunds for incompatible or locked devices

No refunds for user error in installation or activation
8.2 Refund Eligibility
Refunds may be issued in the following circumstances:
Technical Issues (Our Fault):

eSIM profile fails to install due to our system error

eSIM activates but cannot connect to any Network Partner in the designated coverage area

Service is significantly degraded due to our fault, not Network Partner issues
Duplicate Orders:

You accidentally purchased the same plan multiple times
-
Must be reported within 24 hours of purchase
Fraudulent Charges:

Unauthorized charges on your account

Must be reported within 14 days with supporting evidence
8.3 Refund Process
To request a refund:

10. Privacy and Data Protection

Availability: We do not guarantee uninterrupted, timely, secure, or error-free service

Network Quality: Data speeds, coverage, and network performance depend on Network Partners

Device Compatibility: We do not warrant compatibility with all devices

Third-Party Services: We are not responsible for third-party services or content
11.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

11.3 Network Partner Limitations
Simnity acts as a reseller and service aggregator. We do not own or operate telecommunications networks. Service quality, coverage, and availability are provided by third-party Network Partners. We are not liable for:

12. Limitation of Liability
12.1 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMNITY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO SIMNITY IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
12.2 Exclusion of Damages
IN NO EVENT SHALL SIMNITY BE LIABLE FOR:
